Lawsuit Targets Allegedly Fraudulent Houston Towing Companies

Filing Focuses on Family of Alleged Fraudsters

HOUSTON, Dec. 16 /PRNewswire-FirstCall/ — Three family members operating Houston automobile towing, storage and repair companies lead a list of seven defendants accused of over-charging for routine tow services and disassembling vehicles belonging to unsuspecting Harris County accident victims.

The charges are laid out in a lawsuit filed Wednesday by Allstate Insurance Company in Harris County – alleging fraud and false representation involving more than 100 Houston area motorists. The lawsuit is seeking actual and exemplary damages totaling more than $180,000.

The suit alleges the defendants intentionally overcharged Allstate Insurance Company and falsely claimed “tear downs” of some vehicles in their possession were authorized by the vehicle owners – further escalating charges to the insurer.

Allstate filed the suit in Harris County state District Court against individual business owners, Faraj “Sam” Said, Ghassan “Gus” Said, Ibrahim Said, and Patrick Green, their corporate entities and their related towing, storage and repair companies.

The lawsuit was filed following an extensive investigation by Allstate’s Special Investigative Unit and seeks reimbursement of monies Allstate has paid in alleged overcharges.

“Phony insurance claims take an extra $200 to $300 out of every consumer’s pocketbook annually in the form of higher premiums,” says Jim Murray, Allstate assistant vice president in charge of the company’s Special Investigative Unit. “Allstate has no tolerance for this crime, and we will continue to fight insurance fraud on behalf of our policyholders and consumers in general.”

False Representation

The lawsuit alleges the defendants engaged in conduct intentionally designed to defraud Allstate by falsely representing the “true nature and origin of their services.” The City of Houston and Harris County strictly regulate the amount automobile towing and storage companies can legally charge in any “non-consent” tow, which is often initiated by a police officer at the scene of an accident. The lawsuit alleges in many cases, the defendants falsely represented that their towing and storage services were requested or initiated by the vehicle owner. The lawsuit alleges the defendants then charged significantly higher rates for their services than allowed for “non-consent” towing and storage services.

Vehicle in Pieces

The lawsuit also contends the defendants falsely claimed that “tear down” of the vehicle in their possession was authorized by the vehicle owner. Tear down is a process used by body shops to evaluate damage to vehicles and estimate repair costs – leaving the car or truck in pieces and more difficult to move to a repair facility potentially preferred by the vehicle owner.

The Defendants

The defendants named in the lawsuit include Faraj “Sam” Said, Ghassan “Gus” Said, Ibrahim Said, Patrick Green, Noor Said Enterprises Inc. (aka Noor Enterprise Inc.), Budget Collision Inc. and National Auto Collision, Inc. The lawsuit identifies several businesses operated by the named Defendants, including National Auto Collision, Budget Auto Collision, Holmes Road Storage, South Loop Storage amongst others.

A Midlands car dealer has taken on a new premises as part of expansion plans.

Rybrook has taken up a lease at the Heathcote Industrial Estate, in Warwick, which was the previous site of The Spa and Warwick Timber Company.

Having completed the deal, with the help of commercial property specialists EHB Commercial, the company plans to turn the 8,800 sq ft warehouse and office space into a delivery inspection centre for BMW cars.

The site will be used for vehicle preparation as well as carrying out minor repairs to the body and paintwork of vehicles before they are distributed to Rybrook’s retail dealerships across the region – including the company’s Warwick centre, located less than one mile away on Heathcote Lane.

Peter Hemus, property director for Rybrook, said: “The facilities are much better than anything we had previously and there is significantly more storage capacity at this site, which was a big factor in our decision to locate here.”

Eight people will be employed at the Harriott Drive site once it is up and running.

MANHATTAN, Kan., Dec. 1 /PRNewswire-USNewswire/ — When you leave home for the holidays, it’s important to choose the best housing option to ensure your pet’s well-being, a Kansas State University veterinarian said.

“It can be very stressful for some pets to be away from their owners,” said Dr. Susan Nelson, assistant professor of clinical sciences at K-State. “This stress also may be intensified if the time away is spent in unfamiliar surroundings, so try to prepare in advance in order to make your pet’s holiday time as stress-free as possible.”

Nelson said the primary options for pet care are a kennel or a pet sitter. Kennels are a good option for sociable animals that don’t stress about leaving the house, and pet sitters are a good option for animals that are more at ease at home, especially cats. She said it’s important to consider your pet’s behavior before hiring a sitter.

“It’s best to know whether your pet will be OK staying at home by itself and if it would let a stranger into the home while it’s alone,” Nelson said.

Some territorial and aggressive dogs don’t respond well to a stranger in the home and won’t allow someone unfamiliar to enter. Additionally, Nelson said dogs with extreme separation anxiety are best not left at home alone but instead taken to a kennel if there are no other options.

“These are the dogs that when left alone bark all day or have accidents in the house,” she said. “They may exhibit destructive behavior and even injure themselves. Some pet sitters will watch your pet in their home, so this may be a more suitable option for certain pets.”

To help pets adjust to temporary holiday housing, owners should help prepare their pet beforehand. If hiring a pet sitter, owners should schedule a greeting time when the sitter can meet and play with the pet.

“When the sitter comes to meet your pet, don’t be in the house so that you’ll find out how your pet will react to a stranger without you there,” Nelson said.

If your pet isn’t used to you being gone, you should leave the pet alone at home for short periods of time to prepare for a longer absence. Nelson said owners shouldn’t emphasize leaving and greeting their pet when they return, because this can reinforce its anxiety.

For pets going to the kennel, Nelson said owners can help their pet adjust to living in a smaller space by purchasing a crate for the home.

“You can get your pet used to the crate by having it stay in the crate a couple minutes at a time at the beginning and then slowly increasing that time,” she said. “It’s also helpful to feed pets when they’re in the crate so they get used to confinement during a low-stress time.”

To help ease your pet’s anxiety at the kennel, you can arrange play dates so your pet becomes used to being around other animals, Nelson said. Owners also can bring the animal’s favorite toy or something that smells like home, such as a T-shirt, to the kennel.

When choosing a pet sitter, Nelson suggests finding a family member, a friend or a professional. If hiring a professional pet sitter, pet owners should ask about the sitter’s training and experience, check for proof of insurance and ask for references. She also suggests that owners have professional sitters provide a written contract of their fees and services and ask what extra services they offer, like playing with the pet. If your pet has special needs or takes medication, make sure your pet sitter will be comfortable performing those tasks.

For kennels, Nelson said it’s important to reserve a spot early in the holiday season. When choosing a kennel, owners can visit the facility and see how it looks and smells. They also can see what kind of safety and security the kennel has, such as video surveillance, fire alarms and sprinkler systems

CHICAGO — BDO Seidman, LLP, one of the nations leading accounting and consulting
organizations, released the findings of its annual board compensation
study which tracks board compensation by business life cycle, revenue
segments and industries. The study found that compensation at
introduction phase companies is on the rise despite the difficult
economy. Introduction phase companies are also offering higher
compensation than all other business life cycles at $96,405 per year.
The introduction phase is classified as a company that has
recently completed an IPO or restructured. Other business life-cycles
measured include: growth, mature and decline stage
companies.

In order to reach the introduction phase in the current economy,
a company must be nearly fiscally flawless, said Randy Ramirez,
Regional Practice Leader in the Compensation and Benefits practice at
BDO Seidman. The introduction phase companies that survived this
year had an advantage over companies in other life-cycles. Remaining
insulated from the financial meltdown, they were able to lure and retain
top board directors by using more attractive compensation plans.

These findings are from the most recent edition of The BDO 300:
2009-2010 Survey of Board Compensation Practices of 300 Mid-Market
Public Companies which examined the director compensation
practices of publicly-traded companies with annual revenues below $1
billion in the energy, financial services, manufacturing, real estate,
retail and technology industries.

CURTIS WARREN was last night starting a 13-year jail term for masterminding a pounds 1m cannabis smuggling plot.

The sentence, only a year less than the maximum tariff, was passed down by former High Court judge Sir Richard Tucker at Jersey’s Royal Court yesterday.

Toxteth-born Warren was not in court to hear his sentence. Instead, events were relayed to him via videolink to a room at top security HMP Belmarsh.

Dressed in a polo shirt and Adidas tracksuit bottoms, Warren showed absolutely no interest while the cases were being put to the court, preferring to read a book.

When the sentence was passed, he gave only a smirk before leaving the room.

Warren was moved to Belmarsh amid police fears of a plot to spring him from Jersey’s cliff-top prison.

In October, “Cocky” and five others were convicted by a jury of scheming to import up to pounds 1m of cannabis from mainland Europe to Jersey.

It was alleged Warren used his underworld contacts in Holland to set up the deal for longtime Liverpoolborn friend John Welsh, a drug dealer who has lived on Jersey for more than 20 years.

Sentencing Warren, Judge Tucker said: “We do not sentence him because of his record or notoriety. Nevertheless, he has been shown to be the mastermind behind the planned importation, he provided contacts in Holland and was the source of supply.
